Terms of Service
Effective Date: April 28, 2024
1. Ownership of Work
Unless otherwise expressly agreed in writing, Will Powered Media ("Photographer") retains all right, title, and interest, including all copyrights, in all photographs, videos, and media ("Work") created during any assignment. The Work is not a "work-for-hire" as defined under US Copyright Law.
2. Usage License
Upon full payment of the invoice, Photographer grants the Client a limited, non-exclusive, non-transferable license to use the Work solely for the purpose of marketing the specific property listing or project identified in the order.
- Duration: This license terminates once the property is sold, leased, or the listing is withdrawn.
- Prohibitions: Client may not sell, sub-license, or transfer the Work to any third party (including builders, stagers, designers, or future agents) without express written consent and additional licensing fees.
3. Payment & Delivery
Invoices are due upon receipt of the watermarked preview or as specified in the booking agreement. Final, high-resolution Work will be delivered via a secure uplink within 24 hours of project completion, pending full payment or established account terms.
4. Cancellations & Rescheduling
Cancellations or rescheduling requests must be made at least 24 hours prior to the scheduled shoot. Late cancellations may be subject to a 25% "Deployment Fee" to cover operational overhead.
5. Property Readiness
Client is responsible for ensuring the property is "camera-ready" at the time of the shoot. Photographer is not responsible for moving furniture, cleaning, or staging. Significant delays caused by property unreadiness may result in additional hourly "Standby Fees."
6. Technical Accuracy (California AB 723)
Will Powered Media provides high-performance visual edits. It is the Client's responsibility to ensure that all media used in MLS listings complies with California AB 723 and local real estate board regulations regarding "digitally altered" images.
7. Consultation Fee & Retainer
The $50 fee paid at the time of booking via Calendly is a non-refundable retainer for professional consultation and project scheduling. This fee covers the administrative cost of mission initialization and is not refundable in the event of client cancellation.
- Credit: The $50 fee will be applied as a credit toward the final invoice of the project for which it was paid.
- Expiry: If the project is not commenced within 90 days of the consultation, the credit expires and is forfeited.
